Often times when someone is given a traffic ticket or moving violation they have the option of simply "paying it off". When you mail in the payment you are pleading guilty or responsible to the given charge. Prior to doing this, a person needs to consider the impact a conviction will have on one's driving privileges and insurance premiums. Each traffic ticket carries the possibility of points on one's driving record, increased insurance premiums, and a loss of one's driving privileges either in North Carolina or your home state. If you have insurance in North Carolina, an increased insurance premium will last three policy years.

The Department of Motor Vehicles can also revoke or suspend your North Carolina driver's license for certain offenses. Out of state drivers may also be subject to suspensions in their home state upon certain convictions in North Carolina. Old, unpaid traffic tickets will also suspend your license. Convictions for driving while license revoked or any moving violation during a period of suspension will lengthen the period of revocation and can, in some cases, result in jail time and permanent driving privilege suspension. Often times an attorney can shorten or eliminate this period of suspension or get someone in a position to become eligible for a limited driving privilege.

A written Power of Attorney can be used in most traffic cases which keeps the client from personally appearing in court. Attorneys at Hornthal, Riley, Ellis & Maland, LLP have handled thousands of traffic matters and will help you understand what effect a conviction can have on your driving privileges and your insurance premiums. We know what strategies to employ and what prosecutors want to see prior to getting a case dismissed or reduced.

HAVE YOU BEEN CHARGED WITH DRIVING WHILE IMPAIRED?

Driving While Impaired (DWI) is the offense of operating a motor vehicle on a highway, street, or public vehicular area while under the influence of an impairing substance or with an alcohol concentration of 0.08% or more at any relevant time after driving. Being charged with a DWI is a frustrating experience and one that carries serious consequences if convicted. In addition to fines, penalties, and jail time, your driver's license is subject to suspension ranging from one year to a permanent revocation. People who register a Blood Alcohol Content (BAC) of 0.15% or higher, may be required to have an ignition interlock device installed in their car. When a person is charged with driving under the influence on the Federally owned beaches of the Outer Banks then the case is heard in Federal Court located in Elizabeth City.

There are numerous legal issues that arise in every DWI case that should be properly examined. A thorough investigation of the facts and circumstances of your case are essential in determining reasonable suspicion to stop your vehicle, probable cause to arrest, and the admissibility of field sobriety testing. Motions to dismiss the case or motions to suppress evidence may need to be filed in cases involving roadblocks, blood draws, car accidents, or when someone refuses to submit to an alcohol test. The State of North Carolina has the burden of proving your case beyond a reasonable doubt and it is important to hold the State to this high standard.

Our attorneys have experience in dealing with DWI charges and will work relentlessly to achieve the best outcome on your case.
